Two former senior FBI officials face criminal charges over allegations that they lied to Congress about the bureau’s Hunter Biden investigations, bringing fresh scrutiny to the federal officials entrusted with protecting the 2020 election from foreign interference.
Nikki Floris, 46, and Bradley Benavides, 56, surrendered Friday after being charged with making false statements to Congress. The case concerns their work on the FBI’s Foreign Influence Task Force and their subsequent accounts to lawmakers of its involvement in investigations involving the former president’s son, according to the Justice Department.
Prosecutors allege that both officials understated their involvement during interviews with the House Judiciary Committee in 2023. Floris allegedly denied participating in discussions about Hunter Biden while serving on the task force. Benavides allegedly said he learned of the FBI’s possession of the laptop through a Wikipedia article in 2023. The department says communications, documents and witness accounts contradict those statements.
U.S. Attorney Jeanine Pirro announced the charges Friday on X, contrasting the Wikipedia explanation with evidence of “their involvement in helping shape the public narrative about Hunter Biden’s laptop right before the election.” Each former official faces one count of lying to Congress, filed through a criminal complaint.
The allegations revive a controversy that extended well beyond the contents of a computer. As the 2020 election approached, Americans’ access to reporting about the Democratic nominee’s son became entangled with warnings about foreign interference and decisions by powerful technology companies to restrict its circulation.
Mark Zuckerberg acknowledged in 2022 that Facebook reduced distribution of the laptop story after receiving an FBI warning about potential Russian propaganda. Sen. Ron Johnson argued that the bureau’s conduct helped shield Joe Biden from damaging scrutiny. The FBI maintained that it supplied foreign-threat information to private companies but could not direct them to act on it.
The laptop later became evidence for federal prosecutors themselves. New Conservative Post’s 2024 coverage of Hunter Biden’s legal battles detailed how special counsel David Weiss’s team defended the authenticity of material extracted by an FBI forensic specialist. Prosecutors distinguished those extractions from copies circulated publicly and rejected Hunter Biden’s effort to cast doubt on the evidence used against him.
Floris’ attorneys rejected Friday’s charges and accused the Justice Department of pursuing a politically motivated case ahead of the midterm elections.
“Nikki Floris is a patriot. She served our nation as a dedicated FBI intelligence officer for nearly 20 years. Yet today, the DOJ has accused her falsely of a crime on the say-so of politicians, not on the facts. It’s no coincidence the government is filing these nonsense charges now, years later, on the eve of an election,” they said.
“The government’s reasons for charging Nikki are as transparent as they are unjust: to push a false narrative for a shot at political points. It’s another sad day for the DOJ, but we look forward to Nikki’s day in court.”
A response from Benavides was not immediately available in the initial reporting. The charges remain allegations, and both defendants are presumed innocent unless proven guilty.
Friday’s case puts a specific question before the courts: whether officials charged with identifying foreign influence told Congress the truth about their own work. It also renews the broader debate over how the FBI handled politically damaging information about the Biden family when voters were choosing the next president.
